Car Accidents in Florida

Florida is consistently ranked as having some of the most dangerous roads in the country. In 2018, for instance, the department of Florida Highway Safety and Motor Vehicles (FHSMV) reported that there were an estimated 403,626 car accidents in the state that year alone, which breaks down to around 1,106 accidents per day. Unfortunately, those accidents resulted in 236,157 injuries for the parties involved, 19,196, which were incapacitating, and 3,135, which proved to be fatal. These accidents had a number of causes, but most can be attributed to at least one driver’s negligence.

Recovering Compensation for Accident-Related Losses

Florida is a no-fault auto insurance state, which means that in most cases, car accident victims are required to seek compensation through their own insurers, regardless of who was at fault for the accident. The no-fault system does, however, come with some restrictions. For example, Personal Injury Protection (PIP) insurance policies, which all drivers must carry, only reimburse policyholders up to a certain amount. When this amount is exceeded, or a person is able to prove that his or her injuries satisfy the state’s definition of a serious injury, that individual could file a legal claim against the driver in court. Those who are successful in filing these types of claims could be entitled to compensatory damages.

Compensatory Damages

In Florida, accident victims who can prove that someone else’s negligence caused or contributed to their accident are often eligible for compensatory damages awarded by a judge or jury. These kinds of damages, as their name suggests, are intended to compensate injured parties for accident-related losses, with economic damages reimbursing plaintiffs for:

  • Past and future medical expenses;
  • Lost wages;
  • Loss of future income; and
  • Property damage.

Non-economic damages, on the other hand, compensate plaintiffs for losses that are more difficult to quantify, such as the physical pain and suffering and emotional distress endured by an injured party as a result of an accident. Non-economic damages are generally more difficult to calculate than their economic counterparts and will depend on a fact-specific assessment of the severity and type of injuries in question and the defendant’s degree of negligence in causing the crash.
